1. Acceptance of Terms

By accessing or using the Site and its services, including but not limited to browsing, creating an account, participating in meetups, and posting content (the "Services"), you agree to be bound by these Terms of Use (the "Terms"). These Terms constitute a legally binding agreement between you and Bake2.com. If you do not agree to all of these Terms, you are expressly prohibited from using the Site and Services and must discontinue use immediately.

2. Definitions

In these Terms:

• "Account" refers to the account you create to access and use the Services.
• "Content" means text, graphics, images, audio, video, data, and other materials.
• "User Content" means any Content that you submit, post, upload, display, or otherwise make available on the Site.
• "Bake2.com Content" means all Content that is made available in connection with the Services, including any Content licensed from a third party, but excluding User Content.
• "Meetup" refers to any in-person or online gathering organized through the Site.

3. User Eligibility and Account Registration

By using the Site, you represent and warrant that:

• All registration information you submit is true, accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update such registration information as necessary.
• You will keep your password confidential and will be responsible for all use of your password and account.
• You will not share your Account with anyone else.
• You will notify us immediately of any unauthorized use of your Account or any other breach of security.
• You will not create more than one Account.

We reserve the right to refuse registration of or cancel an Account at our sole discretion.

4. Acceptable Use and Prohibited Conduct

You agree to use the Site and Services in a manner consistent with all applicable laws and regulations and in accordance with these Terms. You agree not to:

• Use the Site for any unlawful purpose or for the promotion of illegal activities.

• Post, upload, or transmit any User Content that infringes any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any party.
• Post, upload, or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
• Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
• Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "scrape," or in any way reproduce or circumvent the navigational structure or presentation of the Site or its contents.
• Engage in any conduct that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site.
• Organize or promote Meetups that are illegal, unsafe, or violate these Terms.
• Discriminate against or harass other users based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting such user to law enforcement authorities.

5. User Content

5.1 Responsibility for User Content

You are solely responsible for your User Content and the consequences of posting or publishing it. By posting User Content, you represent and warrant that:

• You are the creator and owner of the User Content or have the necessary licenses, rights, consents, releases, and permissions to use and authorize us and other users of the Site to use your User Content in the manner contemplated by the Site and these Terms.
• Your User Content does not and will not infringe, violate, or misappropriate the rights of any third party, including any intellectual property rights or rights of privacy or publicity.
• Your User Content is not false, inaccurate, or misleading.
• Your User Content does not violate any law, statute, ordinance, or regulation.

5.2 License to User Content

By posting User Content to the Site, you grant to us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content in connection with the operation of the Site and our business, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) in any media formats and through any media channels. This license includes the right for other users of the Site to access and use your User Content as permitted through the functionality of the Site and under these Terms.

5.3 Removal of User Content

We have the right, but not the obligation, to monitor, review, edit, remove, or disable access to User Content at any time, without notice and for any reason, including but not limited to if we believe that such User Content violates these Terms.

6. Intellectual Property

6.1 Bake2.com Content

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Bake2.com, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Bake2.com Content for your personal, non-commercial use.

6.2 Trademarks

The Bake2.com name and all related names, logos, product and service names, designs, and slogans are trademarks of Bake2.com or its affiliates or licensors. You must not use such marks without our prior written permission.

6.3 User Content

As between you and Bake2.com, you own the rights to your User Content. By posting User Content, you grant us the license described in Section 5.2.

7. Disclaimers of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, BAKE2.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. BAKE2.COM DOES NOT WARRANT THAT THE SITE OR SERVICES, OR ANY PORTION THEREOF, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS. BAKE2.COM MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT ON THE SITE OR THE CONTENT OF ANY SITES LINKED TO THE SITE. ANY RELIANCE ON THE SITE OR SERVICES IS AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAKE2.COM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF BAKE2.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BAKE2.COM'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE OR SERVICES EXCEED THE AMOUNT YOU HAVE PAID TO BAKE2.COM IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS (\$100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION TO BAKE2.COM, AS APPLICABLE. THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN BAKE2.COM AND YOU.

9. Termination

We may terminate or suspend your Account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your Account, you may simply discontinue using the Services. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bake2.com, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your violation of these Terms or your use of the Site or Services, including, but not limited to, your User Content, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

11. Dispute Resolution

If a dispute arises between you and Bake2.com, our goal is to provide you with a neutral and cost-effective means of resolving the dispute quickly. In the event of a dispute, we encourage you to first contact us directly to seek a resolution. If we are unable to resolve the dispute informally, any legal action or proceeding relating to your access to or use of the Site or Services shall be brought exclusively in the state or federal courts located within [Insert your state/jurisdiction] and you consent to the personal jurisdiction of such courts.

15. Miscellaneous
